1. Agreement and business terms
These Terms of Use (“Terms”) are between Maryam LLC (“Maryam,” “we,” “us,” or “our”) and the person accessing DockDash. DockDash is a software platform owned and operated by Maryam LLC, a Delaware limited liability company.
If you use DockDash for an employer or another organization, you represent that you are authorized to use the service on its behalf. A separate subscription, services, order, or customer agreement between Maryam LLC and that organization controls if it conflicts with these Terms.
By accessing or using DockDash, you agree to these Terms. If you do not agree, do not use the service.
2. Accounts and authorized access
You must provide accurate information, protect your credentials, and promptly notify your organization or DockDash Support of suspected unauthorized access. You are responsible for activity performed through your account except to the extent caused by our breach of these Terms.
You may use DockDash only for the organization and purposes for which your access was authorized. Account administrators may manage access, permissions, records, and account status.
3. Acceptable use
You may not:
- Access DockDash without authorization or attempt to bypass security or access controls.
- Interfere with, disrupt, overload, probe, or test the service except through an expressly authorized security program.
- Upload malicious code or use the service to violate law or the rights of others.
- Reverse engineer or copy the service except where applicable law does not permit that restriction.
- Use another person’s credentials or misrepresent your identity or authority.
- Submit information you are not authorized to process or disclose.
4. Limited license and mobile application
Subject to these Terms and any applicable customer agreement, Maryam LLC grants authorized users a limited, nonexclusive, nontransferable, revocable license to access and use DockDash for internal business purposes.
The DockDash driver mobile application may request device permissions necessary for supported features, including camera access, photo selection, notifications, and device authentication. Users can manage applicable permissions through their device settings.
The current application does not request device-location permissions or track driver location. When a user elects to open shipment directions in an external navigation application, such as Apple Maps, the destination information may be passed to that application, which operates under its own permissions and privacy practices.
If the application is obtained through Apple’s App Store, Apple is not responsible for providing maintenance or support for DockDash. Support is provided by Maryam LLC as described at dockdash.ai/support.
5. Customer data and privacy
As between Maryam LLC and the customer organization, the customer retains its rights in information it submits to DockDash. The customer authorizes Maryam LLC to host, process, transmit, and otherwise use that information as necessary to provide, secure, support, and improve the service and to comply with law.
Your use of DockDash is also subject to our Privacy Policy. Customer organizations are responsible for providing required notices and obtaining required permissions for information they submit or direct us to process.
6. Third-party services and integrations
DockDash may exchange information with customer-selected systems, trading partners, mapping providers, communication services, and other third parties. Third-party services are governed by their own terms and practices. Maryam LLC is not responsible for a third-party service outside our control.
7. Ownership and feedback
Maryam LLC and its licensors retain all rights in DockDash, including its software, design, branding, documentation, and improvements. No rights are granted except the limited right to use the service under these Terms.
If you provide suggestions or feedback, you grant Maryam LLC permission to use it without restriction or compensation, provided we do not identify you publicly without permission.
8. Availability, changes, and suspension
We may update the service and its features over time. We may suspend or restrict access when reasonably necessary to protect the service, address security or legal concerns, prevent harm, or enforce applicable agreements. Customer-specific service commitments, if any, are stated in the applicable customer agreement.
9. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCKDASH IS PROVIDED “AS IS” AND “AS AVAILABLE.” MARYAM LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT A CUSTOMER AGREEMENT EXPRESSLY PROVIDES OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARYAM LLC WILL NOT BE LIABLE UNDER THESE TERMS FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. ANY CUSTOMER AGREEMENT MAY ESTABLISH DIFFERENT OR ADDITIONAL LIABILITY TERMS.
Some jurisdictions do not allow certain disclaimers or limitations, so portions of this section may not apply to you.
10. Termination
You may stop using DockDash at any time. Your access may end when directed by your organization, when the applicable customer relationship ends, or when access is suspended or terminated under these Terms or another agreement. Provisions that by their nature should survive termination will survive.
11. Governing law
Unless a customer agreement states otherwise, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Applicable law may provide you with rights that cannot be waived by these Terms.
12. Changes to these Terms
We may update these Terms as the service or applicable requirements change. We will post the updated version at this URL and revise the “Last updated” date. Continued use after an update becomes effective constitutes acceptance where permitted by law.
